A reverse mortgage allows a person over age 62 to borrow against the equity in their home in either a lump sum or monthly payments, and continue to reside in the home. AARP alleges that HUD has changed the rules with respect to surviving spouses who still live in their homes, but who were not on the loan documents. Many of these homeowners are facing foreclosure because their home values have dropped, and the value of the reverse mortgage is greater than the worth of the home.

			                <content type="html" xml:base="https://www.kbzglaw.com/blog/2020/12/keeping-your-older-pet-healthy/"><![CDATA[Pets, like the rest of us, age too.  Molly is ten years old, which is unbelievable to me – I adopted her when I was college, and I’m not ready to admit that was 10 years ago!  You can plainly see the signs of age on her sweet face, as her muzzle (or “nozzle,” as one client called it) is almost completely gray.  She has always been a wonderfully healthy and active dog, but I ran across this article today about keeping your aging pets healthy.  I thought it had some good suggestions.  Molly already eats senior dog food, and I think it has helped her maintain a healthy weight.  However, she gets a lot of snacks and treats at the office, which is something I should keep better tabs on.  I’ve noticed lately, too, that she seems to be startled more, so maybe a vet visit to check her hearing and eyesight is in order.  Keeping up with an older pet is work, but she’s worth it – she’s a great cuddle bug.  What things have you done to make aging easier on your pet?

			                <content type="html" xml:base="https://www.kbzglaw.com/blog/2020/12/brown-bag-biopsies/"><![CDATA[We are fortunate as Americans to have access to many different kinds of healthcare and treatments. However, a new study shows that sometimes there can be too much of a – good? – thing. The study looked at new nursing home admissions in Florida, and discovered that within three months of admission, 71% of residents were prescribed a psychoactive medication! Many of these patients were not taking psychoactive drugs, such as those for depression or dementia, before placement. While a higher incidence of psychoactive drug usage in a skilled nursing facility is to be expected, 71% seems to be a bit excessive. Researchers blamed the problem mostly on systemic deficiencies, such as lack of proper training, and that mental illnesses were not until recently reimbursed at the same rate under Medicare rules.

Overmedication is a frequent problem with the older adult community. I know of a doctor’s office who regularly conducts “brown bag biopsies”: they ask their patients to bring in all of their prescription, over the counter and supplement drugs, and establish which are necessary and which may be no longer needed, or ever scarier, duplicative. So many older adults will not ask questions of their physicians and follow their directions to a tee. As family members and concerned professionals, I think we have a responsibility to ask questions about what our loved ones and clients are being prescribed – simply as an extra layer of protection. It could be as simple as suggesting your client ask their physician for a “brown bag biopsy” on their next scheduled visit.

However, there comes a time when most of us will have to stop driving.  One of my grandmothers voluntarily gave up her license and her car when she realized she could no longer see well enough to drive, and we were all very proud of her for doing so.  But for most people, giving up driving is a very difficult decision and a trying conversation to have with our older loved ones.

In Texas, family, friends, a physicians or even an anonymous person can report unsafe driving to the Department of Public Safety, and ask to have a person’s license medically revoked.  You can make this suggestion to the Medical Advisory Board at the address <a title="Medical Revocation Page" href="http://www.txdps.state.tx.us/DriverLicense/MedicalRevocation.htm/" target="_blank" rel="noopener noreferrer" data-wpel-link="external">on this page</a>.  DPS has previously used a form DL-76, which can be <a title="Form DL-76" href="http://www.texasagingnetwork.com/caregivers-corner/DPS%20Examination%20Request.pdf" target="_blank" rel="noopener noreferrer" data-wpel-link="external">found here</a>, although it is not currently available on the DPS website.

The Medical Advisory Board will contact the individual and investigate whether or not a person is able to drive due to a medical condition.  This can result in the revocation of a license, either permanently or pending a comprehensive exam.  In addition, once a license is revoked, the driver must submit proof of insurance to reinstate his or her license.  It may be difficult, if not impossible, to insure a driver who has had his or her license medically revoked.

Another way to have a driver’s license revoked is through a guardianship proceeding.  Under Texas law, a judicial declaration of incapacity can revoke a driver’s license.  This, however, would be a last resort and should not be taken lightly.
